General Terms and Conditions – Classigogo B.V.

• • Only adults (at least 16 years old) can create an account and purchase.
• • Students use Classigogo only under the supervision of an adult (teacher/school) and do not have their own account.
• • We do not process data that makes a child directly identifiable.
• • Subscriptions are continuous with automatic renewal; cancellation is easy online, effective immediately at the end of the current term.
• • We apply a reasonable Fair Use Policy against clearly evident abuse.
• • For content moderation we apply a notice-and-action process.
• • These terms are governed by Dutch law, without prejudice to mandatory consumer rights in the consumer’s country of residence.
• • Right of withdrawal: consumers in the EU and the UK generally have a 14-day right of withdrawal; you can find the Model (cancellation) form here: www.classigogo.com/assets/files/Model Cancellation Form.pdf.

• Account: the online registration of an adult (at least 16 years old) to use and/or manage the Services.
• Consumer: a natural person who is not acting in the course of a trade or business.
• Teacher/School: an adult or educational institution that deploys the Services in a class or school context.
• Services: Classigogo’s software, websites and any apps.
• User Content: content uploaded or entered by users such as quizzes, media and names.
• Student/Child: a minor student who participates in activities within the Services without their own account.
• Personal Data: all information relating to an identified or identifiable natural person.
• Student Data: all (personal) data related to students/children.

These terms apply to every use of the Services. In addition, our Privacy Policy applies to the processing of (personal) data. In the event of a conflict between these terms and the Privacy Policy — insofar as data protection and privacy are concerned — the Privacy Policy prevails; in all other cases these terms take precedence.

3.1 Minimum age. You may only create an Account and make purchases if you are at least 16 years old.

3.2 Students have no Account. Students use the Services only under the supervision and responsibility of a Teacher/School via a shared screen or via sessions hosted by the Teacher; they have no individual login or commercial contact with Classigogo.

3.3 Consent & responsibility. The Teacher/School guarantees that use in the classroom complies with applicable laws and regulations (including privacy and parent/school consent where required) and that students are adequately supervised.

4.1 We offer the Services worldwide, subject to applicable export and sanctions laws.

4.2 We do not warrant that the Services are available or legally permitted in every country. You are responsible for complying with local rules that apply to you.

5.1 Ongoing. Paid subscriptions continue with automatic renewal per term (e.g., month/year). Current prices are shown in your Account.

5.2 Transparency. Before purchase we display the price, term, renewal interval and cancellation method.

5.3 Cancellation as easy as sign-up. You can cancel online at any time before the next renewal date via your Account or via the indicated digital route. Cancellation takes effect at the end of the current term.

5.4 Reminders. Where legally required we send a reasonable reminder before renewal (e.g., for trial periods or annual renewals).

5.5 Billing errors. Report billing errors within 60 days; we investigate and correct reasonable errors.

6.1 Trial period. If you start a free trial that automatically converts into a paid subscription, we will inform you clearly in advance; you can cancel before conversion.

6.2 Right of withdrawal (consumer). With an online purchase within the EU/UK you generally have a 14-day right of withdrawal. For digital services this right may lapse after your explicit consent to immediate delivery and your acknowledgment that the right of withdrawal then lapses.

6.3 Refund. Upon valid withdrawal we reimburse according to statutory time limits and rules.

7.1 No directly identifiable data. We do not ask for or knowingly collect data that makes a child directly identifiable (such as full name, email address, phone number, home address or photos of faces) for use of the Services in the classroom.

7.2 Limited, necessary processing. To make the Services work, limited, not directly identifiable information may be technically necessary (e.g., device/session characteristics, game interaction, aggregated statistics). This processing takes place solely to deliver, secure and improve the Services, not for behavioral advertising or sale of data.

7.3 COPPA (US). Insofar as we fall under the U.S. COPPA rules, we rely—where permitted—on consent via the School/Teacher solely for educational purposes. We do not use child data for marketing, do not profile for advertisements and do not share child data with third parties outside the necessary service provision.

7.4 Requests & deletion. Do you believe directly identifiable child data has inadvertently reached us? Contact us immediately; we will delete such data after verification without unreasonable delay.

7.5 DPA & international transfers. For schools/organizations we conclude a DPA upon request. Transfers outside the EEA/UK are covered by appropriate safeguards (e.g., EU Standard Contractual Clauses and/or the UK IDTA/Addendum). See also our Privacy Policy.

8.1 Ownership. You retain all intellectual property rights to your User Content.

8.2 License to Classigogo. You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, display, distribute and make limited edits to the User Content (e.g., for moderation/safety, format conversion) solely to deliver, secure and improve the Services.

8.3 Public sharing. If you choose to share content publicly, Classigogo may display that content to other users within the Services. You can withdraw that sharing at any time; we cannot guarantee that existing copies can be removed in all cases.

8.4 Infringement & DMCA. In case of (alleged) infringement of copyrights or other IP rights we apply a notice-and-takedown process: submit your notice by email or post with sufficient information to identify the material and its location, your contact details and a good-faith statement. Where appropriate we may remove or restrict access, inform the uploader and provide a brief counter-notice route; in case of repeated infringement we may restrict or terminate accounts; misuse of this process may lead to measures. Classigogo has designated and registered the following agent with the U.S. Copyright Office for notices of alleged copyright infringement: Copyright Manager, Classigogo B.V., Saturnusstraat 95, +31 702211507, info@classigogo.com.

9.1 What is not allowed. You shall not use the Services for unlawful acts, for violating third-party rights (including IP rights), for posting illegal or harmful content, for circumventing security, for scraping or massive automated requests, or for disrupting others’ use.

9.2 Fair Use. We apply a reasonable Fair Use Policy. Clearly evident abuse—such as automated massive traffic that exceeds normal school scenarios, systematic sharing of a single license across multiple schools, or large-scale distribution/copying of non-public material—may lead to a warning, temporary limitation or suspension. We will communicate in advance where reasonable and give you the opportunity to stop the abuse, unless there is a risk to safety or third-party rights.

10.1 Reporting point. You can report illegal or infringing content including: description, URL, legal basis (if known) and your contact details.

10.2 Handling. We carefully assess reports and may remove content or restrict accounts.

10.3 Statement of reasons & appeal. If measures are taken you will receive a concise reason. You can appeal within 14 days via the indicated channel.

11.1 We strive for high availability but do not warrant that the Services are uninterrupted, error-free or entirely free of vulnerabilities.

11.2 We may modify, add or discontinue functionality. For material changes that are adverse to you, we will inform you in advance (unless urgent security or legal reasons oppose this). You may in that case terminate the subscription at the end of the current term.

The Services, underlying software, brand names and materials are protected. You receive a limited, revocable, non-transferable license to use the Services in accordance with these terms. Reverse engineering, sublicensing or resale is not permitted unless expressly allowed by law or agreed in writing.

13.1 Exceptions. Nothing in these terms is intended to exclude or limit liability where this is not permitted as a matter of law. In particular, liability is not excluded or limited for: death or personal injury caused by our negligence, fraud, and—where mandatory law so requires—intent or gross negligence.

13.2 Limitations. To the extent permitted by law we are not liable for indirect damages, consequential damages, lost profit or revenue, loss of data, loss of use, reputational harm or costs of replacement, arising from or related to the Services, regardless of the legal theory (contract, tort or otherwise).

13.3 Liability cap. To the extent permitted by law, our total cumulative liability to you is limited to at most the fees you have paid for the Services in the 12 months prior to the event causing the damage. This cap does not apply to the exceptions mentioned in 13.1.

13.4 Movement & safety disclaimer. Certain parts of the Services may involve physical activity. Use takes place only under the supervision of an adult (Teacher/School). The Teacher/School ensures that (i) the space is suitable and free of obstacles, (ii) the physical condition of students is taken into account, and (iii) students do not participate if physical exertion is medically inadvisable. The Services do not provide medical advice. This provision leaves 13.1 unaffected.

13.5 Consumer rights. For consumers the above limitations apply insofar as permitted by mandatory consumer law; your statutory rights remain unaffected.

You indemnify us against third-party claims arising from your breach of these terms or of third-party rights, insofar as permitted by applicable law.

15.1 Law. Dutch law applies, without prejudice to mandatory consumer protection of the country where the consumer lives.

15.2 Forum. Disputes will be submitted to the competent court in The Hague, Netherlands, or—if you are a consumer—to the court of your place of residence where that is mandatorily prescribed.

We may amend these terms. For material changes we will, where possible, inform you in advance by email or in-product message. If you do not agree, you may terminate your subscription at the end of the current term.
